Effective
The agreement between you and Talona, Inc. It is short on purpose. The part worth reading twice is clause 4, because a browser that can do anything on the open web is a tool you are responsible for pointing somewhere lawful.
1. The agreement
These terms are between you and Talona, Inc., a Delaware corporation at 131 Continental Dr, Suite 305, Newark, DE 19713, USA. Creating an account or calling our API means you accept them. If you are accepting on behalf of a company, you are telling us you are allowed to.
2. What the service is
Talona gives your software a real browser running in our cloud, driven over MCP or our API. What that browser does is up to you. We provide the machine, the session, and the tools around it.
3. Your account
Give us accurate details, keep your API keys secret, and treat everything done with your key as done by you. Tell us at hello@talona.ai if a key leaks and we will help you rotate it. You need to be 18 or older.
4. How you may use it
You are responsible for what your agents do, including for obeying the law and the terms of the sites they visit. You agree not to use Talona to:
- Break the law, or help anyone else break it.
- Access an account or a system you are not authorised to access, including by testing stolen or guessed credentials.
- Defeat a security control on someone else's service, as opposed to presenting a browser that looks like a browser.
- Collect personal data you have no lawful basis to collect, or infringe someone's copyright, trademark, or trade secrets.
- Send spam, run fraud or phishing, or manipulate a platform's ranking, reviews, or voting.
- Handle content that is illegal to handle anywhere we operate.
- Overload, probe, or interfere with our infrastructure, or resell raw access to it as your own browser platform.
Automating a site you do not own carries risk that is yours, not ours. Read the robots file, read the terms, and do not assume our stealth features are permission.
5. Credits, plans, and payment
Usage is measured in credits, and one balance covers model tokens, browser compute, memory, and live view data. Subscriptions carry a monthly allowance and renew until you cancel. Work stops when the allowance runs out rather than billing you past it. API usage is prepaid and spends down as you use it.
Fees are exclusive of tax and are not refundable except where the law says otherwise. We can change prices, and we will give notice before a change touches a plan you are already on. Cancel at any time and your plan runs to the end of the period you have paid for.
6. Who owns what
You own your data, your prompts, and whatever your sessions produce. You give us the licence we need to host and process it in order to run the service, and nothing more. We own Talona itself, including the software, the docs, and the brand.
7. Availability
We work hard to keep Talona up and publish its status at status.talona.ai. We do not commit to an uptime figure unless we have signed one with you separately. Features can change, and we will give reasonable notice before removing one you depend on.
8. Suspension and termination
You can close your account at any time. We can suspend or close yours if you break clause 4, if you do not pay, or if your usage is threatening the platform for everyone else. Where the situation allows it, we will warn you first and give you a chance to fix it. On termination we delete your data as described in the privacy policy.
9. Disclaimers
Talona is provided as is. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. An agent driving a browser is a probabilistic thing operating on websites we do not control, and we do not warrant that any given run will succeed or that any given site will keep working the way it did yesterday.
10. Liability
Neither of us is liable to the other for indirect, incidental, or consequential damages, or for lost profits or lost data. Our total liability under these terms is capped at what you paid us in the twelve months before the claim. Nothing here limits liability that cannot lawfully be limited.
11. Indemnity
If someone brings a claim against us because of how you used Talona, including what your agents did to their site, you will defend us and cover what it costs.
12. Governing law
Delaware law governs these terms, without regard to its conflict of law rules, and the state and federal courts of Delaware are where disputes are heard.
13. Changes
We will post any new version here and move the effective date at the top. Carrying on using Talona after a change means you accept it. If a change is material, we will email account holders first.
