Terms of Service

1. Agreement

These terms are an agreement between you and Talona, Inc. ("Talona" or "we"). They apply when you use talona.ai, the rework estimator or the Talona service.

By using them you agree to these terms. If you use Talona for a company you confirm you can agree for it. If you have signed an order form or another agreement with us, that agreement takes priority where the two differ.

2. The Talona Service

Talona reads the site channels a customer connects, such as WhatsApp groups, email and drawings. It keeps a record of each job, answers questions from it and flags changes. We improve the service all the time, so features can change.

3. Your Account

Keep your login details safe and tell us if you think someone else is using your account. You're responsible for what happens under your account and for who you invite.

4. Your Content

You own what you and your crews send to Talona. You let us process it only to provide the service to you and keep it running.

You confirm that you have the right to share that content with us and that the people in your groups know Talona is reading them.

5. AI Output

Talona uses AI to read messages and to draft answers, alerts and estimates. AI can be wrong. Check anything important before you act on it, such as a change order, a price or a schedule.

6. The Rework Estimator

The estimator combines your website, the numbers you give and public benchmarks. Its results are illustrative and can be off. They aren't financial, legal or professional advice.

7. Acceptable Use

Don't use Talona to:

  • break the law or anyone's rights
  • send malware or try to get into systems or data you shouldn't
  • scrape the site or put it under unreasonable load
  • copy or resell the service without our permission
  • process data you aren't allowed to share

8. Other Services

Talona works with services from other companies, such as WhatsApp. Their own terms apply when you use them.

WhatsApp is a trademark of Meta Platforms, Inc. Talona is not affiliated with or endorsed by Meta.

9. Fees

Prices and payment terms for paid plans are set out in your order form.

10. Our Property

Talona, Inc. owns Talona's software, design and brand. These terms give you no rights to them beyond using the service as described here.

If you send us feedback we may use it without owing you anything.

11. Privacy

Our Privacy Policy explains how we handle personal data. Where we process personal data for a customer our data processing agreement also applies.

12. Ending Your Use

You can stop using Talona at any time. We may suspend or end your access if you break these terms or if the law requires it. When an account ends we delete its content as our Privacy Policy describes.

13. Disclaimers

Talona is provided as it is and as available. As far as the law allows we make no promise that it will be uninterrupted, error-free or fit for a particular purpose.

14. Limitation of Liability

As far as the law allows we aren't liable for indirect or consequential losses such as lost profits or lost data. Our total liability for any claim is limited to what you paid us in the 12 months before it arose.

Nothing in these terms limits liability that the law doesn't allow us to limit.

15. Changes to these Terms

We may update these terms and will change the date at the top when we do. If a change is significant we'll tell you by email or on the site before it applies. Using Talona after that means you accept the new terms.

16. Governing Law

These terms are governed by the laws of the State of Delaware. If you're a consumer you keep the protections of the law where you live.
